The CFTC has granted Kalshi a license to operate as a designated contract market (DCM), meaning it must ensure fair trading and transparent settlement. The key rule is that no trader may possess material non-public information—the classic insider trading prohibition.

But what happens when the information is public, yet distributed at different speeds? That is the problem Truth Social's API creates. The API delivers posts in real time, before they appear on the website or the app. For a human trader, the delay between seeing a post and reacting is at least a few seconds. For a machine connected to the API, the delay is milliseconds. In a market where contracts settle based on whether a specific word appears in a speech, those milliseconds are the difference between profit and loss.

Consider the 'Gabriel Perez case' from earlier this year. Perez was a former Kalshi employee who allegedly used non-public knowledge of the exchange's internal data to trade on contracts. That was classic insider trading: someone with access to privileged information used it to front-run the market. The CFTC froze his accounts, and the case is ongoing. Senator Ron Wyden has written a public letter questioning the fairness of the Truth API arrangement. He is right to be concerned. The CFTC must decide whether speed discrimination constitutes a form of market manipulation or unfair access. The precedent set in the Perez case—where the employee was charged with fraud for accessing non-public internal data—could be extended to cover the case of a public data stream that is not publicly equitably distributed.

Truth is immutable, unlike the price action. That is a phrase I have used many times to describe the finality of blockchain transactions. But it applies here too: the truth of an event does not change based on who observes it first. The price, however, does. And if the price moves before the truth can be verified by all, then the market fails its fundamental purpose.

The liquidity will migrate to the fast traders, and the spreads will widen for everyone else. You will become the exit liquidity for algorithms. That is not decentralization. That is a heist wearing a regulatory license.

But Chainlink's nodes are centralized in practice, and the latency is not guaranteed.
